2. Your use of the Site
a. The Site is provided solely for individuals looking for employment opportunities within the Social Media space (Candidates) and for employers looking to recruit staff (our Customers). You may only use the Site for your own personal and non- commercial use. Business or commercial use (whether or not for profit) is strictly prohibited without our prior written permission.
b. Where you are required to register to use the Site you agree that you will provide truthful, accurate and complete information only.
c. All copyright, database rights and other intellectual property rights in the Site and the material available on it belongs to us or our third party suppliers. Your use of the Site gives you no proprietary rights in such materials.
d. Any content (including CVs, whether you are a Candidate or a Customer) you upload to the Site will be considered non-confidential and non-proprietary. You will retain all of your ownership rights in your such content but warrant that you hold such rights and you agree to grant us a limited licence to use, store and copy that content and distribute and make it available to Candidates or our Customers (as the case may be). We retain the right to disclose your identity and share such content to with our Candidates or Customers (as the case may be) and as well as any third party who is claiming that any content posted or uploaded by you to the Site constitutes a violation of their intellectual property rights or of their right to privacy.
e. Although we shall do our best to maintain the Site’s continuous availability we shall not be held responsible for any downtime to the Site, however caused.
f. Except as required by law we make no representations or warranties of any kind in respect of the Site and the services we make available through it. All information and/or data included in and/or on the Site and as a result of the services we provide through it are made for guidance only and your use of such information/data is entirely at your own risk.
g. To the extent permitted by law neither we nor any of our directors, employees or other representatives shall have no liability for any loss suffered as result of your use of the Site or any services provided through it.
h. You agree to indemnify us and all companies within our group for all losses, costs, actions, claims, damages, expenses (including reasonable legal costs and expenses) or liabilities, whatsoever suffered or incurred by us in or as a consequence of your breach of these terms and your use of the Site and any services we provide through it.
3. Data protection
b. You acknowledge that where any personal data is accessed or otherwise processed by a Customer, that Customer shall be the sole data controller of that personal data for the purposes of the Data Protection Act 1998 and as such be solely responsible for its processing.
c. We do not store credit card details nor do we share financial details with any 3rd parties
4. Service Delivery
a. Social Media Jobs offer two package options, 1) a Standard Job Listing which is £150+VAT or 2) a recruitment service where we will find you a candidate for a percent of the salary on offer.
b. Customers are required to pay in full before a job listing is made live. Upon successful payment, the job listing should go live immediately, if this is not the case please contact support via our contact page and we will investigate why this has not happened.
c. Each job listing is live for 90 days only unless the Customer pays again to renew the job listing.
c. Candidates looking for a job may register and use our services for free.
5. Refund Policy
a. Social Media Jobs refunds are entirely subject to our discretion.
b. Once a job post has been made and is live, Customers may edit the advert at any time to correct any mistakes, avoiding the need for a refund.
c. The payments may be refunded or rejected if we deem the payment made as being from an illegitimate source.
6. Viruses and misuse
a. We do not guarantee that the Site will be secure or free from bugs or viruses, although we will always use reasonable endeavours to ensure that any files downloaded from our site are virus free.
b. You must not misuse the Site by knowingly introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server from which it operates or any server, computer or database connected to the Site. You must not attack the Site via a denial of service attack. You must not attempt to crawl the Site, deep link to any part of it or use bots to pull data from the Site. Any breach of this provision will be reported to the relevant law enforcement authorities and we shall cooperate with such authorities by disclosing your identity to them. In the event of such breach your right to use the Site shall terminate immediately and we may block your access to it.
c. You are responsible for configuring your own hardware and software to access the Site and we recommend that you use your own virus protection software before you upload your CV or any other content to the Site. We may in our sole discretion irretrievably erase any files uploaded to the Site by you that contain viruses or other malware.
a. You acknowledge that we provide no support for your use of the Site.
c. You acknowledge that we may terminate your access to the Site at any time without incurring any liability to you whatsoever.
d. If we ignore or fails to enforce any breach of these terms, this does not mean we cannot enforce our rights in the future. If any part of these terms is found to be invalid by a court, it shall be replaced with a similar provision which achieves the same purpose as the original, so far as is possible, with the remainder of the terms remaining unaffected.
e. These terms are governed by and are to be interpreted in accordance with English law. If any dispute arises between you and us such dispute may only be heard in the English courts.
